Living Wills & Health Care Directives

South Florida Estate Planning Lawyer

Have you thought about what would happen if, one day, you were unable to make critical decisions about your health? Ask yourself these questions:

  • Who would make medical decisions for me?
  • Would my health care preferences be known?
  • Am I comfortable with the thought of my family members, physicians, or judges making life-or-death decisions for me?
  • Would my family members know what my wishes are regarding end-of-life medical care?

At the Law Offices of Mary Jean Catinchi Mella, P.A. in Coral Gables, Florida, I understand how important it is to plan for the future - regarding both financial and health-related matters. I offer legal services to individuals and families to create living wills and health care directives which accurately reflect wishes about future healthcare decisions and end-of-life medical care.

Living Wills · Health Care Directives · Medical Powers of Attorney

A living will is a legal document that records an individual's health care preferences, most commonly used if an individual is one day unable to make health-related decisions for him or herself. Living wills address an individual's preferences regarding life-prolonging procedures and treatment. Living wills are also referred to as health care directives and advance directives.

Many individuals with living wills are choosing to appoint a health care surrogate. A health care surrogate, is an individual designated to make decisions for another individual if he or she becomes unable to do so. Health care surrogates can only make health-related decisions if the individual they represent is unable to communicate their wishes themselves.

No One Likes to Think About Death, Dying or End-of-Life Care

Like a lot of people, you may be uncomfortable thinking about a future in which you may be unable to make health-related decisions for yourself. However, failure to express your wishes regarding medical decisions and end-of-life care issues can leave your family members conflicted and confused. Without specific guidance about your values, and the kinds of care you would like in different situations, they may find themselves feeling guilty if they don't take every possible action which could prolong your life - even if that is not what you would want.

As an attorney who handles living wills and health care directives, I understand the personal and sensitive nature of topics related to an individual's financial and health-related futures. That is why I focus on providing compassionate legal services that meet the unique needs of each client I represent.
